Pure Note is operated by Digitalbits 64 LLC, a company registered in Georgia.
By downloading, installing, accessing, or using Pure Note, you agree to these Terms of Service. If you do
not agree, do not use the service.
If you are under the age required to enter a binding contract where you live, you may use Pure Note only
with the involvement of a parent or legal guardian.
2. What Pure Note Provides
Pure Note is a note-taking application that may include:
Text and checklist note creation
Optional Google Sign-In and Google Drive sync
AI-assisted writing and transcription features
Premium paid features
3. Accounts and Security
Google Sign-In is optional. Core note-taking features work without an account, but
sign-in is required for sync and some entitlement-restoration flows
You are responsible for account security. Keep access to your device, Google account,
and any app-lock credentials secure
Accurate information. If you contact support or request account help, provide accurate
information so we can verify the request
4. Your Content and AI Output
4.1 Ownership
You keep ownership of the content you create in Pure Note. These Terms do not transfer ownership of your
notes, attachments, or other user content to us.
4.2 Permission to Operate the Service
You authorize us and our service providers to process your content only as needed to operate the app
features you choose to use, such as sync, authentication, AI features, entitlement validation, support,
and security controls.
4.3 AI Features
AI features are optional
If you use them, you instruct us to send the content you choose to submit to external AI providers for
processing
AI output may be inaccurate, incomplete, offensive, or unsuitable for your purpose
You are responsible for reviewing AI output before relying on it
5. Paid Features, Billing, and Refunds
5.1 Premium Access
Some features require a paid subscription or one-time purchase.
Premium access may be offered through:
Apple App Store
Google Play, where available for the relevant platform, territory, and merchant setup
A web merchant of record or checkout provider shown at checkout, if web sales are
offered
A qualifying purchase may unlock the same premium entitlement across supported Pure Note clients after you
sign in to the same account.
5.2 Billing and Auto-Renewal
Prices are shown before you confirm a purchase
Recurring subscriptions renew automatically unless you cancel before the renewal date
Billing, taxes, renewals, and payment processing are handled by the store or checkout provider used for
the original transaction
For any web purchase, the checkout flow will identify the merchant of record or checkout provider,
price, billing interval, taxes, and cancellation / refund terms before payment is completed
5.3 Managing Purchases
Apple purchases must be managed through your Apple account settings
Google Play purchases must be managed through your Google Play account settings
Web purchases, if offered, must be managed through the portal or support channel of the merchant of
record or checkout provider used for that purchase
5.4 Refunds and Consumer Rights
Refund requests are handled by the provider that processed the original transaction, subject to that
provider's policies and any mandatory law that applies to you
If a web merchant of record handles a sale, that provider's checkout terms and refund rules will apply
in addition to these Terms
Nothing in these Terms limits any mandatory refund, cancellation, withdrawal, or other consumer rights
you have under applicable law
5.5 Immediate Access to Digital Features
If you purchase premium features and request immediate access, we may start providing the digital service
immediately after purchase. To the extent permitted by law, this may reduce or end any statutory
cooling-off or withdrawal right once the digital service has started or been fully supplied.
6. Acceptable Use
You may not:
Use Pure Note for unlawful, fraudulent, or abusive activity
Attempt to bypass security, entitlement checks, usage limits, or payment controls
Reverse-engineer or exploit the service except where non-waivable law expressly permits it
Interfere with other users, the app, or connected services
Use AI features in a way that violates law or third-party rights
7. Intellectual Property
Pure Note, excluding your content, includes software, branding, design elements, and related intellectual
property owned by us or our licensors. These Terms give you a limited, non-exclusive, non-transferable
right to use the service for its intended purpose.
8. Availability, Support, and Warranties
We do not promise uninterrupted or error-free availability
Third-party dependencies such as Google, Apple, Firebase, Google Drive, or a checkout provider may
affect availability
You should keep appropriate backups of important content
Except where prohibited by law, the service is provided "as is" and "as available." This does not limit
any statutory warranties or consumer guarantees that cannot legally be excluded.
9. Liability and Consumer Protections
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence,
death or personal injury caused by negligence where such liability cannot be excluded, or any other
liability that cannot lawfully be excluded or limited.
Nothing in these Terms limits any non-waivable consumer rights you have under the law of your place of
residence.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special,
consequential, or punitive damages
We are not liable for losses caused by third-party platforms or providers outside our reasonable
control
Our aggregate liability arising out of or relating to the service will not exceed the total amount
you paid for Pure Note in the 12 months before the event giving rise to the claim
10. Suspension, Termination, and Account Deletion
You may stop using Pure Note at any time.
We may suspend or restrict access if we reasonably believe you are violating these Terms, creating security
risk, or using the service unlawfully or abusively.
If you delete your account, some transaction, accounting, or legal-compliance records may still be retained
where required by law.
11. Changes to These Terms
We may update these Terms for legal, security, operational, or product reasons.
If a change materially affects your rights or obligations, we will provide reasonable advance notice before
the updated Terms take effect, such as through the app or another reasonable method. Changes will apply
prospectively, not retroactively, unless required by law.
If you do not agree to the updated Terms, you must stop using Pure Note and cancel any subscription before
the changes take effect.
12. Governing Law
These Terms are governed by the laws of Georgia, excluding conflict-of-law rules, except to the extent
mandatory consumer-protection law in your place of residence applies and cannot be excluded.
If you are a consumer, nothing in this section prevents you from relying on mandatory rights or bringing a
claim where applicable law allows you to do so.
